PER COURT :-

1. Heard the learned counsel for the parties.

2. The applicant/complainant has requested to withdraw the amount deposited by the petitioner. The amount has been deposited against the cheque. It is not in dispute that the applicant/complainant is entitled to receive the said amount. Complainant/applicant - Ganesh Avachitrao Shejul is entitled to receive the amount deposited by the respondent/petitioner - Bansilal Rajaram Pathare, on certain conditions.

3. The Registry is directed to pay the amount of Rs.7,00,000/- (Rs.Seven Lakhs) to the applicant/complainant - Ganesh Avachitrao Shejul on the condition that he shall furnish an undertaking that he would redeposit the said amount within a month with interest at bank rates prevailing at the relevant time, if the judgment is reversed.

4. In the above terms, the application stand allowed.
