                              PER COURT:

                              1.                 This is an application for fixing the appeal for hearing.

                              The applicant has been acquitted vide judgment and order dated

                              22nd August, 2015 for offences under the Prevention of Corruption

                              of Act.

                              2.                 Learned counsel for the applicant submitted that, since

                              the appeal preferred by the state challenging the judgment of

                              acquittal has been admitted by this Court, the applicant has been

                              deprived of certain pecuniary benefits. He is entitled for gratuity

                              which has been stayed due to pendency of this appeal.                           He is

                              receiving provisionary temporary pension.                The applicant has

                              undergone coronary angioplasty and suffering from various other

                              ailments and heavy expenses are incurred for medical treatment.

3.                 Learned APP submitted that there is no urgency in the

matter. The appeal is pending since - 2017.

4.                 It appears that on account of admission of appeal

against acquittal, the applicant is not getting certain employment

benefits.          In these circumstances hearing of appeal can be

expedited.

5.                 Hence, I pass the following order:

                                     ORDER

i.Criminal Appeal No.39 of 2017 be added to the final hearing

board commencing from 2nd January, 2023.

ii. Interim Application is disposed off.
