1. By order dated 20th March 2022 notice was issued to the appellant through Nagpur Central Prison. Apparently notice has been served upon appellant. The Jailor, Nagpur Central Prison has forwarded statement of appellant stating that he has preferred appeal challenging judgment of conviction for offence under Section 376 of IPC and under the provisions of POCSO Act The sentence of imprisonment will be over within short span of time and hence he does not want to pursue the appeal. The statement is taken on record.

2. Vide order dated 20th March 2022 it was also recorded that learned advocate representing appellant had returned the papers to Digitally signed by MANISH MANISH SURESH SURESH THATTE Date: 2022.04.05 THATTE 11:11:54 +0530

appellant as he intended to engage another advocate. It was also submitted that communication was issued to the appellant at his residence as the learned counsel was not aware in which jail 2 of 2 16.Apeal.1003.2017.doc

appellant was detained. Learned advocate for appellant submit that he may be discharged from appearing in these proceedings. In the circumstances, the advocate appearing for appellant is discharged from appearing in these proceedings.

3. In view of the report submitted by the Jailor, the appeal is disposed of as withdrawn. The report is taken on record. The professional fees of appointed advocate shall be paid to him as per rules.
