2. The contention of the petitioner is that since the services of the petitioner were protected prior to 15/06/1995, as per Government Resolution dated 15/06/1995, on account of invalidation of the Tribe Claim of the petitioner, the petitioner had claimed himself to be belonging to "Koli Mahadeo" (Scheduled Tribes), the petitioner obtained Caste Validity Certificate of he belonging to "Koli" (Special Backward Class Category), which categorization has also been accepted by the college of the petitioner and therefore, the impugned order dated 04/01/2021 now putting the petitioner on supernumerary post is illegal. The learned counsel for the petitioner places reliance upon the view taken by the Co-ordinate Bench of this Court at Aurangabad in Writ Petition No.903 of 2020 (Raja Tukaram Shinde..vs..State of Mah. & anr. ) and other

connected mattes, in judgment and order, dated 04/05/2021.

3. Issue notice for final disposal at admission stage to the respondents, returnable after four weeks.

4. Ms N.P.Mehta, learned A.G.P. waives service of notice for the respondent Nos. 1 and 4.

5. Meanwhile, no coercive steps be taken against the petitioner, until further orders.
