One of the contentions urged by the learned Senior Advocate for the applicant is that in the judgment under review a finding has been recorded in paragraph 21 that despite notice to produce the letter dated 02.02.2000 and the Resolution dated 01.02.2000 passed by the School Committee, the said documents were not produced on record by the applicant. It is submitted by referring to the list of documents at Exhibit 30 that the Resolution dated 01.02.2000 as well as the communication dated 02.02.2000 were placed on record at serial numbers 10 and 11 of that list. It is thus submitted that as the aforesaid documents were placed on record, the observations made in paragraph 21 may not be justified.

Issue notice to the non-applicants, returnable in three weeks. Shri A.S.Fulzele, learned Additional Government Pleader waives notice for the non-applicant no.2.

By returnable date, the record of Appeal No. 23/2000 be called from the School Tribunal, Amravati.

Until further orders direction no. 4 in the operative part of the judgment shall remain in abeyance.
