By the present Miscellaneous Civil Application, the applicant / appellant No.2 seeks transfer of Appeal No.59 of 2006 from judgment and order dated 21.10.2005 in T. E. & R. Suit No.253 / 274 of 2003 pending before the Chief Judge in Court No.3 in the Court of Small Causes. The transfer is sought apprehending that the matter will not be dealt fairly and bias is attributed.

2. I have extensively heard the counsel for the applicant and the learned senior counsel representing respondent No.8.

3. On perusal of the Application and for the reasons to be recorded separately, the Application is rejected.
