1. The writ petition is already admitted and is pending final hearing. In the meantime, admittedly, there is a civil suit (Regular Civil Suit No.422 of 1999) filed between the parties before the Court of learned Civil Judge, Junior Division, Islampur. The prayer of the applicants in this application is that the suit has now proceeded and judgment is likely to be delivered and hence the suit pending before the Civil Judge, Junior Division, Islampur be stayed. The suit is of the year 1999 and it ought to proceed, however, subject to rights and contentions of the parties which they would assert in the present petition.

2. Needless to observe that the parties would have to abide by the order passed by this Court in the present proceedings.

3. The interim application is disposed of in the above terms. No costs.
