1. On 22nd July, 2021 we had wrongly recorded the presence of Ms. Purnima Kantharia as counsel for respondent No.2. Actually, it should have been Ms. Purnima Awasthi.

2. Today we have heard Ms. Aditi Saxena, learned counsel for the petitioner; Ms. Uma Palsuledesai, learned AGP for respondent- State; and Ms. Purnima Awasthi, learned counsel for respondent No.2.

3. Pursuant to our order dated 22 nd July, 2021, medical board of Sir J. J. Group of Hospitals, Mumbai has submitted medical report dated 27th July, 2021. As per report of the medical board petitioner has suffered mental distress due to marital discord. She does not

suffer from mental illness at present. She is of sound mind and there is no evidence of mental incapacity to raise the child. Distress due to ongoing marital discord can be overcome through marital counseling which has been recommended. Further, medical board is of the opinion that there is no psychiatric indication for medical termination of pregnancy.

4. Let a copy of this report be furnished to learned counsel for the petitioner who may make necessary submissions on the next date. She may also circulate copies of judgments which she wants to rely upon with advance copies to learned counsel for the respondents.
