   1              Heard learned Counsel for the parties.


   2              By this Application, the Applicant Insurance Company is seeking

stay of the operation and implementation of the judgment and award dated

20.10.2015 passed in Motor Accident Claims Tribunal Application No.181 of

2013 till the hearing and final disposal of the First Appeal.

3 The learned Counsel Mr. Nikhil Mehta for the Applicant submits

that as per earlier order dated 21.06.2016 passed by this Court, they deposited

the entire awarded amount in Tribunal. Statement is accepted.

4 This fact is not disputed by the learned Advocate appearing on

behalf of Claimants. Hence, by consent of both the parties, the following order

is passed :

i) Civil Application is allowed in terms of prayer clause (a) which

reads thus :

"a) That this Hon'ble Court be pleased to stay the effect, execution, operation and implementation of the Judgment and Award dated 20.10.2015 passed in M.A.C.T. Application No.181 of 2013 by Shri B.N. Kadam - Ex-Officio Member, MACT & District Judge - 2, - Raigad @ Alibag."

ii) Rule made absolute accordingly.

iii) No order as to costs.
