PER COURT :-

1. The learned counsel for the petitioners/original

objector submits that being aggrieved by the judgment

and order passed by the District Collector, Ahmednagar

the petitioners have preferred Grampanchayat Appeal

No.85 of 2019, which is delayed by some days. The

learned Additional Commissioner by impugned

judgment and order dated 19.12.2019 has dismissed the

said appeal solely on the ground that there is no

provisions for condonation of delay while entertaining

the appeal under the provisions of the Maharashtra

Village Panchayats Act.

2. Learned counsel submits that in Writ Petition

no.1962 of 2018 (Anjanabai Ashok Shide Vs. State of

Maharahstra) the Division Bench of this Court has

made the reference for deciding the point involved in

this matter and said reference is yet not decided.

3. In view of the above, by keeping the point of

limitation open, and subject to the decision of the

reference, issue notice to the Respondents, returnable

on 14.6.2021. Learned AGP waives notice for respondent

nos. 1 to 3.
