The appellant failed to file private paper book despite the orders of this Court dated 9.7.2018 and 5.2.2019.

2 Ultimately, vide order 4.6.2019, this Court directed that if the private paper book is not filed within four weeks, the appellant shall deposit cost of Rs. 2,000/- in High Court Bar Association, Nagpur. 3 Today, there is no appearance on behalf of the appellant.

4 The private paper book is not filed nor is the cost deposited.

5 It is more than apparent that the appellant is not interested in prosecuting the appeal. It would be an abuse of the process of law if the appellant is permitted to defy the orders passed by this Court from time to time. I do not see any purpose in keeping such matters pending. The docket of the Court is already over burdened and every pending matter which is not prosecuted and indeed in which the applicant does not bother even to file private paper book

notwithstanding the orders of this Court, takes a toll on the pendency and the ultimate casualty is matters which are more meritorious and which are being vigilantly pursued. 6 In exercise of inherent powers, this appeal is dismissed with cost of Rs. 10,000/- to be deposited with the High Court Legal Aid Sub Committee, Nagpur. 7 If any application for restoration is moved, the Registry shall ensure that the cost of Rs.10,000/- is paid.
