The Court made the following:

This Criminal Petition Under Section 482 of Bharatiya Nagarik

Suraksha Sanhita (BNSS) (under Section 438 of Cr.P.C.), is filed

seeking to enlarge the petitioners/accused on anticipatory bail in Crime

No.255/2024 of Nallajerla Police Station, East Godavari District,

registered for the offence punishable under Section 109 of Bharatiya

Nyaya Sanhita (BNS).

2. Heard Sri Srinivas Ambati, learned counsel for

petitioner/Accused and Sri Neelothpal Ganju, learned Assistant Public

Prosecutor for respondent/State.

3. Perused the record.

4. During hearing, the learned Assistant Public Prosecutor placed a

copy of memo regarding alteration of Section from Section 109 of BNS

to Section 117(2), 351(3) of BNS. The same is placed on record.

5. Having heard both sides, It is seen that all the offences are

punishable with imprisonment less than seven years. It is, in these

circumstances, investigating Police are directed to comply with Section

35 of Bharatiya Nagarik Suraksha Sanhita (BNSS) (under Section 41-A

Cr.P.C) and all the directions given by the Hon'ble Supreme Court in

the judgment in Arnesh Kumar vs. State of Bihar and other related

rulings.

6. With these observations, the Criminal Petition is disposed of.

Miscellaneous petitions, if any pending, in the Criminal Petition,

shall stand closed.
