The Court made the following order:-

The present writ petition is filed to direct the respondents to release the

interest amount to the petitioner on the payments received towards supply of

48 four wheeler (mini) transportation vehicles to the beneficiary fishermen

under the SCC, STC and BCC Action Plan from 2017-18 and consequently

direct the respondents to pay the amount of Rs.1,82,39,251/- towards interest.

Learned counsel for the respondents filed written instructions, wherein it

is stated that there is no such provision for payment of interest on the delayed

payment of the principle amount. Further it is stated that this Court vide

judgment dated 26.04.2022 in W.A.No.791 of 2022 has categorically held that

the appellant has to approach the Civil Court for interest and also this Court

vide common judgment dated 02.12.2022 in W.A.Nos.461 of 2022 & batch

dismissed the plea of the similarly placed appellants. Hence, prayed to

dismiss the present writ petition.

Therefore, the present writ petition is disposed of directing the petitioner

herein to approach the Civil Court for interest on the delayed payments. There

shall be no order as to costs.

As a sequel thereto, miscellaneous Petitions pending, if any, shall stand

closed.
