Heard.

Learned counsel for the petitioner submitted that, contrary to the settled principles of law, Revenue Divisional Officer has entertained the representation made by the unofficial respondent and got issued notice to the petitioner invoking the provisions under Act, 1971. He further submitted that, if at all the unofficial respondents have any grievance against the issuance of pattadar passbooks in favour of the petitioner, they have to approach Joint Collector by filing revision, instead, they have approached RDO by way of representation and the RDO has issued notice. In fact, the RDO has no jurisdiction to entertain the grievance of the unofficial respondents. Questioning the same, present writ petition has been filed. In support of his contentions, learned counsel for the petitioner relied on the judgment in Ratnamma Vs The Revenue Divisional Officer dated 24.07.2015 and prayed to pass appropriate orders in that regard.

Prima facie, a point has been made out for consideration for which a detailed counter is required and notices have to be ordered to the unofficial respondents. As such, this Court is inclined to pass the following interim order:

There shall be stay of all further proceedings pursuant to the notice dated 01.06.2023, pending further orders.
