The petitioner challenges the judgment and order, dated

28.08.2023, passed in W.P. No.26391 of 2021.

2. The petitioner had filed the petition challenging the order of

cancellation of his fair price shop dealership on the ground that the

authorisation was forged and resorted to fraud. An appeal appears to have been preferred by the petitioner before the appellate authority, which came to be rejected vide order, dated 17.04.2021, by the Revenue Divisional Officer - respondent No.3 in the writ petition. The appeal preferred before the District Collector - respondent No.2 was also rejected vide order, dated 08.09.2021. The matter finally came up before the writ Court when a direction was issued to the District Collector to investigate into the matter

and submit a report.

3. The District Collector, Kurnool submitted a report on 25.07.2025 after going through the written submission of the petitioner. The report indicates that the authorisation relied upon by the petitioner, which is stated to have contained the signatures of the competent officer - Sri B. Ch. Obulesu, were forged inasmuch as the said officer i.e., Sri B. Ch. Obulesu, in his statement, had clearly stated that the signatures were not his and more so, he was not even posted at Adoni but was working in Penukonda in Anantapur District. In those circumstances, the writ Court, having been satisfied that the authorisation relied upon by the petitioner was not genuine and actually resorted to fraud and forgery,

dismissed the writ petition.

4. We have heard the learned counsel for the parties. We find no merit in the present Letters Patent Appeal. The views expressed by the writ Court based upon the material on record are perfectly legal

and suffers from no illegality or perversity.

5. The appeal is, accordingly, dismissed. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
