                 APPEAL SUIT No.458 of 2009

JUDGMENT:

1. Sri Varun Kumar, learned counsel for appellant

representing Sri R.N.Hemandaranath Reddy is present and

submits that appellant/3rd defendant before the learned trial

court is not desirous of prosecuting this appeal any further and

requested the court to close the case.

2. O.S.No.289 of 2003 is a suit filed by sole plaintiff as

against 10 defendants seeking for partition. No relief was

claimed against defendant Nos.9 and 10 therein.

3. After due contest, learned trial court decreed the suit in

which each of the defendants including the present appellant

was allotted one share each.

4. As against that, defendant No.3 alone preferred this

appeal and respondent No.1 is the plaintiff and rest of the

defendants are shown as remaining respondents in this

litigation concerning partition.

5. Considering the submissions of the learned counsel for

appellant, this appeal is dismissed as not pressed. There shall

be no order as to costs.

As a sequel, miscellaneous petitions, if any pending, shall

stand closed.
