CIVIL MISCELLANEOUS APPEAL No.242 OF 2006
JUDGMENT:-
This Civil Miscellaneous Appeal is preferred under
Section 75(1) of the Insolvency Act, against the impugned
order dated 31.01.2006 in I.P. No.1 of 2001 on the file of
Senior Civil Judge's Court, Sompeta, Srikakulam District.
None represented the matter, despite the matter is
posted under the caption dismissal.
Nonetheless, Sri A.Rama Rao, learned counsel for the
respondents would submit that, though the 1st respondent
died, no steps have been taken inspite of filing memo
informing the same to the Court. It appears that, they have no
interest in prosecuting the matter.
Accordingly, the Civil Miscellaneous Appeal is dismissed
for default. No order as to costs.
As a sequel, miscellaneous petitions pending, if any,
shall stands closed.
