Learned counsel for the petitioner is present.

At the time of hearing, learned Assistant Public Prosecutor submitted that due to stay granted by the Hon'ble Court at the inspection, PRC No.4 of 2014 on the file of the Court of II Additional Judicial First Class Magistrate, Tanuku, could not be committed to the Court of Sessions.

In view of the judgment of the Hon'ble Supreme Court of India in Asian Resurfacing of Road Agency Private Limited and Another v. Central Bureau of Investigation (2018) 16 SCC 299, stay is not in force. The Committal Court is directed proceed with the matter according to Law.

Post the matter on 09.08.2023.
