CIVIL MISCELLANEOUS APPEAL No.466 OF 2009
JUDGMENT:
1. Both counsel would submit that the matter is
compromised as per the terms agreed between the parties. For
ready referrence, the terms and conditions is extracted below:-
"Because the issue of liability is not under the challenge, however, during deliberation with the counsel/parties and officers, out of the deposited amount Rs.4,25,058/-(Rupees Four Lakhs Twenty Five Thousand and Fifty Eight only) an amount of Rs.3,75,058/-(Rupees Three Lakhs Seventy Five Thousand and Fifty Eight only) with accrued interest thereon is granted to the Claimant/Respondent towards compensation and the remaining amount Rs.50,000/-(Rupees Fifty Thousand only) with accrued interest is given credit to the Appellant/Insurance Company".
2. In the light of the above mentioned terms as both
parties agreed for the settlement, the Civil Miscellaneous Appeal
is disposed of.
3. Accordingly, the Civil Miscellaneous Appeal is
disposed of as per the terms arrived between the parties. There
shall be no order as to costs.
As a sequel, interlocutory applications pending, if any, in
this Civil Miscellaneous Appeal shall stand closed.
