WRIT PETITION No.41976 of 2022
ORDER:
The petitioner had executed a contract work for construction
of CC road and Drain at BC colony of Reddipeta Village of Dallipeta
Gram Panchayat, vide Agreement No.2018-2019, dated
06.02.2019. As the petitioner was not paid his dues amounting to
Rs.8,45,439/-, he has approached this Court by way of the present
writ petition. The petitioner shall also submit his GST Number.
2. A learned Single Judge of this Court, in similar
Circumstances, after considering the earlier orders of this Court,
by an order dated 08.02.2022 in W.P.No.3074 of 2022, had
directed that the respondents should pay the principal amount of
the bill raised by the petitioner therein while leaving it open to the
petitioner to agitate his right for interest.
3. In the said circumstances and following the said
judgment, this writ petition is allowed, with a direction to the
respondents to finalize the amounts payable to the petitioner
within a period of three weeks from today and in any event to pay
the amounts due to the petitioner within a period of six weeks
thereafter.
4. Needless to say, it would be open to the petitioner to
agitate his rights for payment of interest in an appropriate forum.
There shall be no order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall
stand closed.
