WRIT PETITION No.2380 of 2023
ORDER:
The petitioner had executed a contract work towards the
cost of the material under an agreement. After execution of the
said contract, a final bill for a sum of Rs.1,17,945/- had been
prepared. As the payment of the said amount has not been
made by the respondents, the petitioner has approached this
Court, by way of this writ petition.
2. A learned Single Judge of this Court, in similar
Circumstances, after considering the earlier orders of this Court,
by an order dated 08.02.2022 in W.P.No.3074 of 2022, had
directed that the respondents should pay the principal amount
of the bill raised by the petitioner therein while leaving it open to
the petitioner to agitate his right for interest.
3. In the said circumstances and following the said
judgment, this writ petition is disposed of with a direction to the
respondents to finalize the amounts payable to the petitioner
within a period of three weeks from today and in any event to
pay the amounts due to the petitioner within a period of six
weeks thereafter.
4. Needless to say, it would be open to the petitioner to
agitate his rights for payment of interest in an appropriate
forum. There shall be no order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall
stand closed.
