I.A NO. 2 OF 2022 This interlocutory application is filed by the petitioner/Accused No.1, who was convicted by judgment dated 08.01.2019 in SC/ST S.C No.12 of 2014 on the file of the Learned X Additional Sessions Judge, East Godavari at Rajamahendravaram, seeking to release him on bail pending disposal of the Criminal Appeal.
Learned counsel for the petitioner, while reiterating the averments in the affidavit, submits that the petitioner is the only son to his parents; that the parents of the petitioner are aged and sick; that the petitioner was on bail till completion of the trial but did not misuse the same and he did not abscond; that the entire case is based on only alleged extra-judicial confession made before Village Revenue Officer, which is a normal method in all cases, and there is no intimacy with him and it is a weak piece of evidence, as observed by this Court and the Hon'ble Apex Court.
Learned Additional Public Prosecutor, on instructions, opposed the bail application and in view of the seriousness of the offences and prayed to dismiss the application.
In view of the seriousness of the offences for
which the petitioner was convicted, based on the evidence on record, we are not inclined to enlarge the petitioner on bail.
Accordingly, the application is dismissed.
