                      This application is filed seeking to condone
                the delay of 17 days in filing the appeal.
                      Heard both the counsels. Perused the
                contents of the material filed along with this
                application.
                      Learned counsel for the petitioners submits
                that the husband of the 2nd petitioner was only
                earning member in the family and due to his
                untimely       death,   the   petitioners    has    to
                accumulate the necessary funds and in that
                process, delay of 17 days occurred in filing the
                appeal. Hence,      learned counsel     requests to
                condone the delay in filing the appeal.
                      Learned       counsel   appearing      for   the
                respondent opposed to allow the petition.

As O.A is filed seeking compensation for the death occurred in the Train accident, on humanitarian grounds, in the opinion of this Court it is desirable to condone the delay.

Hence, this petition is allowed condoning the delay of 17 days in filing the appeal.

This application is filed seeking to declare the petitioner No.3 herein as major by discharging the 2nd petitioner as guardian.

Heard both the learned counsels. Perused the material filed along with this application.

Learned counsel for the petitioners submits that the appeal has been filed aggrieved by the Judgment passed in O.A.No.148 of 2011 dated 16.10.2019. At the time of filing the claim petition, petitioner No.3 was minor and now he became major. Hence, the learned counsel prays to allow this application.

Considering the submissions of the learned counsel for the petitioners, this application is allowed.

Registry is directed to amend the cause title accordingly.
