Learned counsels appearing for the official
respondents submit that they have not received
instructions from the respective respondents.
The grievance raised in the writ petition is with respect to encroachment and raising of unauthorized construction in the park, the public place, by the 6th respondent.
Learned counsel for the petitioner submitted that though the petitioner represented on many occasions and the last representation was given on 31.05.2022, but no action has been taken on those representations neither before filing of the writ petition nor even after filing of the writ petition. He submits that in the judgment of this Court in Bhagya Nagar Colony Welfare Association, Hyderabad v. Government of Andhra Pradesh and others {reported in 2003(4) ALD 74} any construction in a park area which is for public is prejudicial to the public and cannot be used for any construction contrary to the layout plan.
List on 11.10.2022, as jointly requested, to enable the learned counsels for the respondents,
SL. DATE ORDER OFFICE NO. NOTE including the 6th respondent to file counter affidavits, positively.
If counter affidavit is not filed before that date by the official respondents, the 1st respondent-Principal Secretary of Revenue Department and the 4th respondent-the Commissioner of Municipal Corporation, Ananthapuramu shall appear before the Court on 11.10.2022 with relevant records.
