                  WRIT PETITION No.31409 of 2022
ORDER :

This petition is filed under Article 226 of the

Constitution of India for the following relief:-

"...to issue an order or orders in particularly in the nature of writ of mandamus declaring the inaction of the respondents in not paying the minimum time scale attached to post date Processing Officer/Computer Operator to the petitioner, as same is illegal, arbitrary and unjust and consequently direct the respondents to extend the benefit of minimum time scale to the petitioner in the cadre of data processing officer /computer operator as per the Supreme Court judgment reported in (2017) 1 SCC page 148 Jagjit Singh vs State of Punjab and pass such other order or orders......."

2. When the matter is taken up for hearing, learned

counsel appearing for the petitioner requested this Court,

without touching the merits of the case, to issue a direction to

the respondent authority concerned to dispose of the fresh

representation submitted by the petitioner in view of the

judgment of Hon'ble Supreme Court reported in Jagjit Singh vs

State of Punjab1.

3. Heard learned counsel appearing for the petitioner

and learned Government Pleader for Services-II appearing for

the respondents.

4. Learned Government Pleader appearing for the

respondents readily agreed to dispose of the representation of

the petitioner, if any, pending with the respondent authorities.

5. In view of the submission of both the learned

counsels, as the learned counsel for the petitioner himself

requested to issue a direction to the respondent authority

concerned to dispose of the representation, submitted by the

petitioner in view of the judgment of Hon'ble Supreme Court

referred to above, this Court deems fit to issue such direction.

6. Accordingly, the petitioner is directed to submit a fresh

representation before the respondent authority concerned

within fifteen (15) days from the date of receipt of a copy of the

order and on such submission of representation by the

petitioner, the concerned respondent authority is directed to

dispose of the same in the light of the judgment of Jagjit

Singh's case (supra), in letter and spirit, within a period of

thirty (30) days thereon.

7. With the above direction, the Writ Petition is disposed

of. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this Writ

Petition shall stand closed.
