02 of 2003 dated 07-08-2003 on the file of
Senior Civil Judge, Pithapuram are set aside.
The decree and Judgment dated 30-10-2002 in
O.S.No.195 of 1990 is restored.
In the circumstances, the parties are
directed to bear their own costs.
Consequently, miscellaneous petitions if
any, stands closed. The interim stay if any
granted is hereby vacated.
At request of learned counsel for
Respondents, time is granted up to 28-02-2023
for Respondents to vacate from the plaint schedule property and deliver possession of the property to the Appellant/Plaintiff herein failing which, the Appellant can recover the same by due process of law.
