Criminal Appeal No.3 of 2007 Judgment:
As evident from the proceeding sheet, there was a
representation earlier that the appellant died. The earlier
representation to bring the legal heirs of appellant on record is not
materialized so far.
Today, Smt. Maheswari Arika, learned counsel, representing Sri
M. Venkata Narayana, learned counsel for the appellant, submitted
that the learned counsel for the appellant is not able to trace any
legal heirs of the appellant, as nobody are coming forward. It is
brought to the notice of the Court that already death certificate of the
appellant is filed.
Under the circumstances, as the appellant expired long back
and as the legal heirs of the appellant are not coming forward and
even they are not approaching the learned counsel for the appellant,
this appeal has to be abated.
In the result, the Criminal Appeal is abated.
As a sequel thereto, the miscellaneous applications, if any,
pending in this Criminal Appeal shall stand closed.
