I.A.No.1 of 2022 This application is filed to condone the delay of twenty one (21) days in filing the appeal. Learned Counsel for the petitioner/appellant submitted that notice was served on respondents No.2 and 3, their proof has already been submitted to the registry vide USR No.85659 of 2022. Since the notice was sent to the respondents as given in the Tribunal, the notice is deemed to be served.

Since the respondents have not appeared, the delay is not long and the petitioner has shown sufficient reason for the delay, the petition is allowed.

This application is filed for suspension of judgment and Decree passed in M.V.O.P. No.1022 of 2014, on the file of the Chairman, Motor Accident Claims Tribunal - Cum - I Additional

District Judge, Guntur pending disposal of the appeal.

The learned counsel for the petitioner/appellant submitted on the grounds of appeal that the Tribunal has awarded high amount of compensation without properly perusing the record and also liability of the insurance company has been disowned as the insure has no valid driving license.

Since the adjudication of the appeal will take considerable time and in the light of the submissions made by the learned counsel for the petitioner/ appellant, interim order as prayed for is granted on the condition that the petitioner/ appellant shall deposit 50% of the amount awarded together with proportionate interest and costs within eight (08) weeks from the date of this order. If the petitioner fails to comply the condition, interim order stands vacated.
