WRIT PETITION No.36175 of 2022
ORDER:
The petitioner had raised a complaint against the
respondents 5 to 7, before the respondents 3 & 4 stating that
seeking an investigation against the respondents 5 to 7 on
the ground that they were harassing the petitioner to settle
certain loans amounts and they are threatening the petitioner
to sell away his property worth more than one crore rupees
for settling an alleged debt for an amount of about
Rs.9,00,000/-.
2. As the said complaint was not being taken up, the
petitioner has approached this Court by way of the present
Writ Petition.
3. The learned counsel for the petitioner fairly
submits that in view of the judgment of this Court order
dated 30.07.2022 in W.P.No.8384 and Batch of 2021, the
petitioner has to avail his alternative remedy under Section
156 (3) & 190 r/w. 200 of Cr.P.C by filing a complaint before
the jurisdictional Magistrate.
4. In that view of the matter, this Writ Petition is
disposed of leaving it open to the petitioner to approach the
jurisdictional Magistrate under the above provisions of law.
There shall be no order as to costs.
As a sequel, pending miscellaneous petitions, if
any, shall stand closed.
