In view of the Judgment of this Court in Gara Yesobu and Ors. Vs. State of Andhra Pradesh reported in Manu/AP/1307/2004, there is a prima facie in favour of the petitioners that the offences under the Scheduled Castes, Scheduled Tribes (Prevention of Atrocities) Act, 1989 could not be attracted as the victim is said to have been abused in the name of his community by all the persons in the gathering.
Accordingly, the presence of the petitioners in Spl.S.C.No.81 of 2022 shall be dispensed with till further orders except when their presence is necessary for examination.
