               CRIMINAL APPEAL No.1280 OF 2009
ORDER:-

     This appeal by the complainant is directed against the

judgment of the     Special Sessions Judge-Cum-IV Additional

Sessions Judge, Guntur in Criminal Appeal No. 303 of 2007,

dated 04.11.2008 wherein the appeal filed by 1st respondent-Sole

Accused was allowed setting aside the conviction and sentence

recorded by the Additional Junior Civil Judge, Ponnur in

C.C. No. 142 of 2003 dated 18.09.2007 against him for the offence

punishable under Section 138 of the Negotiable Instruments

Act,1881.

At the time of hearing, learned counsel for the

appellant/complainant submits that the cause in the present

Criminal Appeal does not survive for adjudication and the

present appeal may be dismissed as infructuous.

In view of the same, the Criminal Appeal is dismissed as

infructuous.

Miscellaneous petitions, if any pending, in the Criminal

Petition, shall stand closed.
