Criminal Petition No. 16614 of 2014
ORDER:
1) No representation on behalf of the Petitioners. Heard learned
Additional Public Prosecutor and perused the record.
2) This Criminal Petition, under Section 482 of Code of
Criminal Procedure, 1973, came to be filed seeking to quash the
proceedings, in P.R.C. No. 1 of 2014 on the file of Additional
Judicial First Class Magistrate, Narasapur.
3) At the time, when the matter is taken up for hearing, learned
Additional Public Prosecutor placed on record a copy of the
Judgment, dated 02.08.2019, in Sessions Case No. 290 of 2015,
passed by the Assistant Sessions Judge, Narasapuram, which
arose out of the very same P.R.C., ending in acquittal. Having
regard to the above, the learned Additional Public Prosecutor
submits that nothing survives for adjudication in the present
Criminal Petition and the same may be closed as infructuous.
4) Recording the statement of the learned Additional Public
Prosecutor and having regard to the judgment placed on record,
the Criminal Petition is dismissed as infructuous. No order as to
costs.
5) Consequently, miscellaneous petitions pending, if any, shall
stand closed.
