                     WRIT PETITION No.21881 OF 2022

ORDER:

Heard learned counsel for the petitioners, learned

Government Pleader and learned Standing Counsel for the

respondents.

2. This Writ Petition is filed aggrieved by the action of the

respondents in not paying the interest @ 18% per annum for the

delayed payment of retirement benefits and also productivity

linked incentives for the years 2016 and 2017 to the petitioners

in spite of representations and legal notice dated 09.03.2022.

3. Petitioners are employees of respondents 2 and 3

corporation and they retired from service in various dates.

There was a delay in payment of retirement benefits by the

corporation and the petitioners filed representations to pay

interest on the delayed payments, but the same was not

considered. Hence, the present Writ Petition.

4. Learned counsel for the petitioners relies upon judgment

of the Hon'ble Supreme Court of India reported in Vijay

L.Mehrotra Vs. State of U.P., and others1 and also another

judgment reported in O.P.Gupta Vs. Uion of India and others2

and contends that petitioners are entitled for interest on delayed

payments.

5. Learned counsel for the petitioners also relies upon

G.O.Ms.No.100 Finance (HR.III.Pension-I) Department dated

(2001) 9 Supreme Court Cases 687

(1987) 4 Supreme Court Cases 328

27.06.2018 wherein, interest @ 4.5% to 5% is given for delayed

payments.

6. In view of the facts and circumstances of the case, without

going into merits of the case, the respondents 2 and 3 are

directed to examine the case of the petitioners and take

appropriate decision in the matter, in accordance with law, as

expeditiously as possible,

7. The Writ Petition is disposed of accordingly. No order as to

costs.

As a sequel thereto, the miscellaneous petitions,

if any, pending in this Writ Petition shall stand closed.
