2. 04.02.2022 I.A.No.2 of 2022 (on being mentioned) 18 petitioners had filed the above writ petition and the details of these 18 petitioners are set out in the cause title to the affidavit filed in support of the writ petition. However, only the details of the 1st petitioner were set out in the cause title of the petition itself and the description of the other petitioners was simply shown as "and others". The writ petition has been disposed of on 05.01.2022. The certified copy given by the Registry, only showed the cause title contained in the writ petition itself and the details of the petitioners 2 to 18, in the writ petition, are not available in the cause title of the certified copy of the judgment.
In the circumstances, the present application has been filed for direction to the Registry to place the matter before this Court for further directions.
In the circumstances, the Registry ought not to have passed the petition without the description of the petitioners in the cause title of the petition itself. In that view of the matter, there is contributory negligence on the part of this Court also.
In the circumstances, since the action of the Court should not injure any person, it would be appropriate to direct the Registry to issue a fresh certified copy containing all the names of the petitioners which have been set out in the affidavit
filed in support of the writ petition.
Accordingly, this application is allowed.
