(Per Hon'ble Mr. Justice Ahsanuddin Amanullah) W.A.No.726 of 2021 Heard Mr. Kiran Kumar, learned Government Pleader, Panchayat Raj and Rural Development, for the appellants; Mr. Suresh Kumar Reddy Kalava, learned counsel for the respondent no.1 and Mr. V. Vinod K. Reddy, learned Standing Counsel for the respondent no.2.

It is accepted at the bar that similar issue was before the Court yesterday in W.A.No.724 of 2021, which has been admitted for hearing and interim order staying the direction for payment of interest has been passed.

In view thereof, the Appeal is admitted for hearing.

Post along with W.A.No.724 of 2021. In the meantime, the direction of the learned Single Judge regarding payment of interest to the respondent no.1 as also setting aside the provision in Memo No.1263069/RD.II/A1/2020, dated 05.11.2020 and the Memo No. 1388361/ RD.II/A1/2020, dated 12.05.2021 relating to deduction of 21.02% for DCC works and 6.333% for MCC works, while making payment, shall remain stayed.

The Court would record the stand of learned Advocate General in W.A.No.724 of 2021 that the direction of the learned Single Judge for making payment of the principal amount of the bills raised by the original writ petitioner, in terms of the order of the Division Bench in W.P. (PIL) No.166 of 2019 (Krishna District Grama Panchayathi Sarpanchla Sangam v. The State of Andhra Pradesh and others), shall be complied within four weeks, if already not done.

It is clarified that the appellants shall comply with the rest of the directions issued by the learned Single Judge in the judgment under appeal.
