Petition under Section 397 (1) of Cr.P.C praying that in the circumstances stated
in the affidavit filed in support of the petition, the High Court may be pleased to suspend
the execution of sentence and release the petitioner on bail pending disposal of the
criminal revision case in this honourable court preferred against the judgment of the |
Additional District and Sessions Judge, West Godavari at Eluru made in Cri. A.No.360 of
2019 dated 07-07-2021 confirming the conviction and modified the sentence imposed
against the petitioner in CC.No.345 of 2018 dated 05-08-2019 on the file of the Judicial
Magistrate of 1* Class Special Mobile Court, Eluru, pending disposal of CRLRC No.453
of 2021, on the file of the High Court.

-- The petition coming on for hearing, upon perusing the Petition and the affidavit
filed in support thereof and upon hearing the arguments of SRI1 VN RAJU Advocate for
the Petitioner and of PUBLIC PROSECUTOR for Respondent No.2, the Court made the
following
ORDER:

"Heard.

The sentence of imprisonment imposed against the petitioner/accused in judgment dated 07.07.2021 passed in Criminal Appeal No.360 of 2019 by the learned | Additional District and Sessions Judge, West Godavari, Eluru, modifying the conviction and sentence passed in judgment dated 05.08.2019 passed in C.C.No.345 of 2018 by the learned Judicial Magistrate of First Class, Special Mobile Court, Eluru, West Godavari District alone is suspended pending the criminal revision case on condition of petitioner surrendering before the learned Judicial Magistrate of First Class, Special Mobile Court, Eluru, West Godavari District, and on such surrender, the petitioner shall be released on bail on the same day on her executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties each for a likesum to the satisfaction of the learned Judicial Magistrate of First Class, Special Mobile Court, Eluru, West Godavari District.

The petitioner shall also deposit an amount of Rs.40,000/- (Rupees forty thousand only) before the Court below within four weeks from the date of this order". i ee
