HON'BLE DR. YOGENDRA KUMAR SRIVASTAVA, J.

Heard Sri Rishikesh Tripathi, learned counsel for the petitioners.

Present petition has been filed, seeking a direction to the Rent Authority/Additional District Magistrate-1st, District Banda to decide Case No.793 of 2023 (Sabina vs. Harishchandra Kalvani), under Section 22 (1) of the U P Act No.16 of 2021, within a stipulated time period.

The petitioners have stated themselves to be the applicants in the pending case.

Counsel for the petitioners has referred to the 'order sheet' of the case to point out that the case was instituted on 19.9.2023 and thereafter, though several dates have been fixed, but for some reason or the other, matter has been adjourned. The delay in disposal of the case is stated to be causing hardship to the petitioners.

Attention of the Court has also been drawn to Section 33 (7) of the Act, 2021, to point out that an application filed under Section 22, is to be decided within ninety days from the date of filing such an application before the Rent Authority.

Accordingly, a direction is sought to decide the case expeditiously.

Having regard to the aforesaid, the petition is disposed of with an observation that the Rent Authority/Additional District Magistrate-1st, District Banda, would make an endeavor to decide the aforesaid case, in accordance with law, expeditiously preferably within a period of ninety days from the date of presentation of a certified copy of this order, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
