1. Heard learned counsel for the petitioners and perused the records.

2. This petition has been filed quashing the proceedings of civil appeal No. 2 of 2026 and the order dated 21.01.2026 passed by District Judge, Kushi Nagar at Padrauna.

3. In view of judgment passed in K. Valarmathi v. Kumarsan reported in 2025 INSC 606 passed in SLP (C) No. 21466 of 2024 decided on 29.04.2025, a plaint or an appeal cannot be quashed in exercise of power under Article 227.

4. Accordingly, the petition is disposed of with liberty to the petitioner to avail the remedy as available to him under law.

5. Certified copy of the orders, if any, be returned to learned counsel for the petitioner after retaining photo copy of the same.
