HON'BLE MANISH KUMAR NIGAM, J. 1. Heard learned counsel for the petitioner and perused the record.

2. This writ petition has been filed seeking following relief :-

"i. issue an order or direction to the Respondent No. 1st set and Respondent No.3rd set not to sell the land and the nature of the property in dispute, situated at Village Muiya Pargana Sikanderpur Purvi, District Ballia till the disposal of the 6C Application dated 24.05.2023 filed in Original Suit No.156 of 2023 (Vinod Kumar Tiwari VS Vijay Kumar and others), which is presently pending in the Court of learned Additional Civil Judge (S.D.), Ballia.

ii. It is further prayed that this Hon'ble Court may also be pleased to direct the respondent no.1 not to sell the land in dispute during the pendency of the present misc.petition(civil) before this Hon'ble Court."

3. Learned counsel for the petitioner submitted that the above-mentioned application is pending consideration since 2023 and the same has not been decided till date. Learned counsel prayed that the same may be decided, expeditiously.

4. Since the above-mentioned application is pending, no useful purpose would be served in keeping this petition pending.

5. In view of the above, this writ petition stands disposed of with a direction to the Additional Civil Judge (S.D.), Ballia to decide the above-mentioned application, in accordance with law, expeditiously, preferably within twelve weeks from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
