1. Heard learned counsel for petitioner and learned State Counsel for opposite parties.

2. Petition has been filed challenging order dated 25.10.2025 whereby petitioner has been declared unfit for appointment on the post of Assistant Radio Operator on account of Colour Vision Defects.

It is submitted that earlier petitioner had filed Writ-A No. 10606 of 2025 for a direction to the opposite parties to indicate reasons for declaring him unfit in the medical examination for the purpose of recruitment on the aforesaid post initiated in the year 2022. The said petition was disposed of vide order dated 29.07.2025 directing the authority concerned to consider petitinoer's grievance.

4. It is in pursuance thereof that the impugned order has been passed indicating reason for declaring the petitioner medically unfit.

Learned counsel for petitioner however has drawn attention to the Certificate issued by the District Combined Hospital, Baghpat to submit that there is clear contradiction with regard to alleged medical ailment of petitioner since the Certificate clearly indicates that colour vision of the petitioner is 'normal'. He has placed reliance on the judgment rendered by this Court in the case of Rohit v. State of U.P. and others, Writ-A No. 7186 of 2025 and seeks parity thereof.

6. Learned State Counsel has been provided instructions dated 23.11.2025 which are taken on record and reiterates the aspect that petitioner was found unfit for appointment on the aforesaid post due to Colour Vision on Ishihara plats.

Upon consideration of submissions advanced by learned counsel for parties and perusal of material on record, it is evident that petitioner has been declared medically unfit on ground of the aforesaid alleged ailment. However, the said aspect is clearly disapproved by the Certificate issued by the District Combined Hospital on 04.07.2025 indicating petitioner's colour eye vision to be normal.

8. It is therefore evident that there is discrepancy in medical reports pertaining to alleged ailment suffered by the petitioner.

9. In such circumstances, opposite party No.5, i.e, Chief Medical Officer, District Lucknow, U.P. is directed to constitute a Medical Board for re-examination of petitioner with regard to alleged ailment. Such a Board shall be constituted within a period of ten days from the date a certified copy of this order is served upon him and final decision thereupon shall be taken within ten days thereafter. Further aspect of petitioner's recruitment on the aforesaid post shall be dependent on the report submitted by the fresh Medical Board as accepted by the authority concerned.

10. With the aforesaid direction(s), petition stands disposed of.
