1. Heard learned counsel for the parties.

By means of the present petition, the petitioners have assailed part of order dated 18.09.2021 passed by Deputy Director of Consolidation, Ayodhya/Camp Ambedkar Nagar (in short 'DDC') whereby the application dated 23.06.2015 of predecessor-in-interest of petitioners, i.e. father of petitioners namely Shri Ram s/o Hargen Singh, as indicated in the petition, for recalling of order dated 05.05.1998 has been rejected. This application was registered as Restoration Application No.235 (Shri Ram Singh Vs. Sanjay and others).
3. It would be apt to indicate at this stage that vide order dated 18.09.2025 the D.D.C. decided three restoration applications, i.e. Restoration Application No.208 (Ramashankar Singh & others Vs. Sanjay & others); Restoration Application No.235 (Shri Ram Vs. Sanjay & others) and Restoration Application No.237 (Ugrasain Singh Vs. Shivdaur & others), Village Ashapar, Pargana- Surhurpur, Tehsil- Jalalpur, District -Ambedkar Nagar, in exercise of power under Section 48 of U.P. Consolidation of Holding Act, 1953 (in short 'Act 1953').

5. Brief facts of the case are as follows:-
(i) Vide order dated 07.02.1983, copy of which has not been placed on record, the Consolidation Officer (in short 'C.O.') expunged the name of predecessor-in-interest of the petitioners namely Shri Ram and his brother Shri Bhagwan, both sons of Hargen Singh, from the revenue records of Khata no.597.
(ii) The order dated 07.02.1983 was passed after taking note of the fact that in the revenue records of the settlement year of Gata no.1981 the area shown was 11 bighas and in the records available of subsequent years, the area of Gata no.1981 was shown 15 bighas, thus, excess 4 bighas was mentioned in the revenue records related to Gata no.1981 of subsequent years and therefore, C.O. came to the conclusion that 4 bighas excess has been mentioned in the land recorded in Khata no.597, 627 and 657.
(iii) Indisputably, the order dated 07.02.1983 passed by C.O. was not challenged by means of appeal by Shri Ram s/o Hargen Singh, predecessor-in-interest of petitioners.
(iv) It would be apt to indicate that before the concerned authority no evidence was placed by the predecessor-in-interest of the petitioners namely Shri Ram s/o Hargen Singh to establish that his name was correctly indicated in the revenue records.
(v) Aggrieved party approached the Appellate Authority, who concluded the matter by means of order dated 31.10.1994 passed in Case No.833, under Section 11(1) of Act 1953 (Shivdaur Vs. Shivdaur & others). A perusal of the order dated 31.10.1994 indicates that Shri Bhagwan, brother of predecessor-in-interest of petitioners namely Shri Ram s/o Hargen Singh also approached the Appellate Authority and his name was directed to be expunged from the revenue records of Khata no.597. The operative portion of the order dated 31.10.1994 reads as under.

(vi) Being aggrieved by the order dated 31.10.1994, a Revision No.770 (Ugrasen Singh Vs. Shivdaur & others) was filed under Section 48 of Act 1953. In this revision Shri Ram s/o Hargen Singh, predecessor-in-interest of the petitioners, was impleaded as opposite party no.17 and this revision was decided vide order dated 05.05.1998, which reads as under.

(vii) After the order dated 05.05.1998, an application with a prayer to recall the order dated 05.05.1998, quoted above, was filed by Shri Ram s/o Hargen Singh, the predecessor-in-interest of the petitioners, and this application has been rejected by the impugned order dated 18.01.2021, quoted in para 4 of this judgment.
6. Upon due consideration of facts of the case, indicated above, this Court finds that no interference in the impugned order is required by this Court. It is for the following reasons:-
(i) The order dated 07.02.1983 passed by Consolidation Officer is final as the same was not challenged by Shri Ram s/o Hargen Singh, predecessor-in-interest of the petitioners.
(ii) In compliance of this order dated 07.02.1983, affirmed vide order dated 05.05.1998 passed by D.D.C., the name of the predecessor-in-interest of the petitioners has been expunged from the revenue records pertaining to Khata No.597
(iii) If the application for recall of order dated 05.05.1998 passed by D.D.C. in the revision in which Shri Ram s/o Hargend Singh, predecessor-in-interest of the petitioners was the opposite party no.17, even in that eventuality the order dated 07.02.1983 would remain intact.
(iv) To establish that the name in revenue records of Khata No.597 was correctly indicated, no document/evidence was provided by the Shri Ram s/o Hargen Singh, predecessor-in-interest of the petitioners, either before C.O. or D.D.C.
(v) The reasons indicated in para 6 of the application dated 23.06.2015, quoted below, for filing this application dated 23.06.2015 for recall of final order dated 05.05.1998, after huge delay of above 17 years, are completely vague and misconceived.

7. This petition is accordingly dismissed. Cost made easy.
