At the very outset, learned counsel for the petitioners submits that he does not intend to press the instant writ petition so far as it pertains to the petitioners no. 7 & 8 prays that the writ petition may be dismissed as withdrawn with liberty to file a fresh so far as pertains to the petitioners no. 7 & 8. Accordingly, the writ petition is dismissed as withdrawn so far as it pertains to the petitioners no. 7 & 8 with the aforesaid liberty.

Heard learned counsel for the petitioners, learned Standing counsel appearing on behalf of the respondent no. 1 and Sri Akash Singh, learned counsel appearing on behalf of the respondents no. 2, 3 & 4.

With the consent of learned counsel appearing on behalf of the contesting parties, the instant writ petition is being finally decided.

Present petition has been filed stating that although the petitioners have been paid the amount of gratuity, the interest has not been paid to which the petitioners are entitled by virtue of Section 7(3A) of the Payment of Gratuity Act.

The issue has already been considered and decided by this Court in Writ Petition No.22370 (SS) of 2021 vide order dated 25.10.2021. Thus, following the said judgment, which has been upheld in SLP No.8395 of 2022, the present petition is disposed off directing respondents to pay simple interest at the rate of 6% per annum from 30 days after the date of retirement till the date of actual payment.

The payment as directed above, shall be made within a period of three months.
