The present application has been filed for non compliance of the interim order dated 10.01.2024. The relevant extract of the said judgment is quoted hereinbelow:-
"On the request of learned counsel for the petitioner and without entering into the merits of the case, the present writ petition is disposed of with a direction to the respondent no. 2 i.e. Director Agriculture, Krishi Bhawan, U.P. Lucknow to take a decision on the representations of the petitioner in view of the Uttar Pradesh Government Department Drivers Service (3rd Amendment) Rules, 2013 and the list prepared on 07.08.2013 by the Department under the signature of the Director in which the petitioner has been shown at Serial no. 61 in accordance with law within a period of two months from the date of production/receipt of certified copy of this order."
Learned State counsel has submitted that compliance affidavit has been filed in May, 2024 enclosing therein a copy of the decision taken on the representation of the applicant which is annexed as annexure no.6 to the compliance affidavit. It is further submitted that direction of the writ court was only to decide the representation of the applicant in accordance with law. The respondent had decided the representation of the applicant in accordance with law and made payment which is admissible to the applicant and in support of his submission, he drawn attention of the Court to the documents enclosed with the compliance affidavit i.e. the account details of the applicant where amount has been credited on different dates. It is further submitted that the applicant has not filed any objection against the compliance affidavit though more than nine months have been passed.
On the other hand, learned counsel for the applicant has submitted that there are certain amount which is unpaid.
After hearing learned counsel for parties and going through the record of the case, the judgment and order passed by the writ court has been complied with not as only representation of the applicant has been decided as per direction of the court but payments have also been made.
In view of the facts and circumstances stated above, the present contempt application has become infructuous and the same is dismissed
In case the applicant is still aggrieved, he may avail the remedy as may be permissible under law.
