1. This First Appeal From order was filed on behalf of Insurance Company against the judgment and award dated 04.09.2013 passed by Presiding Officer, Motor Accident Claim Tribunal/Additional District Judge, (Court no.1) in Motor Accident Claim Petition No.312 of 2009.

2. Sri Abhishek Yadav, Assistant Manager of Appellant-The New India Assurance Company Ltd., Sri Abhinav Shukla, learned counsel for the appellant.

3. An application to withdraw this appeal duly signed by Authorised Signatory of Appellant-Insurance Company and learned counsel for appellant, is filed stating that this appeal when instituted had certain arguable issues but during pendency, the subsequent judgments of Apex Court as well as of this Hon'ble Court have covered those issues by deciding matters against appellant and no more arguable issue is now surviving, hence appellant finds no reason to continue with this appeal and is giving consent for dismissal of appeal as not pressed.

4. The appellant has moved the application to dismiss the appeal as withdrawn by his/her free consent and without any coercion/pressure of any kind. The application is kept on record.

5. Accordingly, appeal stands dismissed as withdrawn.

6. The whole decretal amount as awarded if not already paid shall be paid within two months from today.

7. The statutory amount deposited at the time of filing of appeal, if not already remitted, be remitted forthwith to Tribunal.

8. In case, any Cross Appeal/ Cross Objection filed by Claimant(s) is pending, as on date, that may be listed before the Court for disposal in accordance with law.
