1. Heard Sri Manvendra Nath Singh, learned counsel for the petitioners, Sri Ravi Singh Parihar, learned Standing Counsel for the State and Sri Arun Kumar Pandey, learned counsel for the Gaon Sabha.

2. The instant petition has been filed for the following reliefs:-

"i) issue a writ, order or direction in the nature of mandamus directing the respondent no. 1/Consolidation Officer, Sadar, Bijnor to consider and decide the Case No. 81 of 1995 (Sartaj Singh Vs. State under rule 109A(2) of the U.P. Consolidation of Holdings Rules in the light of judgment dated 27.12.2019 (contained in Annexure No. 6 to the Writ Petition) passed by the Respondent No. 2/S.O.C. within a stipulated period as fixed by this Hon'ble Court.

ii) issue any other and further suitable writ order or direction as this Hon'ble Court may deem fit and proper under the facts and circumstances of the present case.

iii) Award the costs of Writ Petition to the Petitioners."

3. Learned counsel for the petitioners submitted that proceeding under Rule 109A(2) of the U.P.C.H. Rules is pending before respondent no. 1-Consolidation Officer in pursuance of the remand order passed by Settlement Officer under Rule 109A (3) of the U.P.C.H. Rules.

4. Considering the entire facts and circumstances of the case, the instant petition is finally disposed of directing the respondent no.1-Consolidation Officer to decide the aforementioned proceeding under Rule 109A(2) of the U.P.C.H. Rules expeditiously, preferably within a period of three months from the date of production of a certified copy of this order after affording proper opportunity of hearing to the parties
