It is stated in the writ petition that the petitioner had instituted a civil suit No.83 of 2019 which was decreed on 05.12.2023. Against the judgment and decree of the trial Court, no appeal was preferred by the contesting defendant-respondent. An execution case No.13 of 2024 was filed, which is pending consideration before the court concerned.

This writ petition has been filed seeking a direction upon the executing court to expeditiously decide the Execution Case No.13 of 2024.

As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Judge Small Cause Court, Allahabad to decide the Execution Case No.13 of 2024, in accordance with law, if there is no legal impediment in deciding the same, after hearing all affected parties, preferably within a period of six months from the date of production of certified copy of this order.

With the aforesaid direction, present writ petition stands disposed of.

It is made clear that this Court has not adjudicated the case on merit.
