HIGH COURT OF JUDICATURE AT ALLAHABAD

?Neutral Citation No. - 2024:AHC:175685

Court No. - 87

Case :- CRIMINAL REVISION No. - 5913 of 2023

Revisionist :- Angad Singh

Opposite Party :- State Of U.P. And 2 Others

Counsel for Revisionist :- Brij Bihari Yadav

Counsel for Opposite Party :- G.A.

Hon'ble Manjive Shukla,J.

1. Heard learned counsel appearing for the revisionist and learned A.G.A. for the State.

2. The instant revision has been filed challenging therein the judgment and order dated 19.08.2023 passed by the Principal Judge, Family Court, Sant Kabir Nagar in Case No. 102/11 of 2020 (Arpita Singh & Anr Vs. Angad Singh) whereby, in exercise of power under the proviso appended to Section 125 Cr.P.C., interim maintenance of Rs. 5,000/- per month had been awarded in favour of Opposite Party No. 2 and interim maintenance of Rs. 3,000/- per month had been awarded in favour of Opposite Party No. 3.

3. Learned counsel appearing for the revisionist has argued that excessive amount of maintenance had been awarded in favour of Opposite Parties No. 2 & 3.

4. It is admitted on record that the revisionist is a government servant and working in the police establishment of the State of Madhya Pradesh. It is also admitted on record that the revisionist is drawing monthly salary of Rs. 60,000/-

5. In view of the aforesaid admitted facts, there is no occasion for this Court to interfere in the impugned order dated 19.08.2023, in exercise of its revisional jurisdiction, more so, when the order dated 19.08.2023 is only an interim order and final determination of maintenance is yet to be made by the trial court under Section 125 Cr.P.C.

6. In view of the aforesaid reasons, I do not find any illegality or infirmity in the impugned order dated 19.08.2023.

7. Accordingly, this revision lacks merit and is hereby dismissed.

Order Date :- 8.11.2024/Gaurav
