Heard.

This is the condonation of delay application in filing the revision.

Cause shown in the affidavit filed in support of condonation of delay application is sufficient.

The condonation of delay application is allowed and the delay of 95 days in filing the revision is hereby condoned.

Heard learned counsel for the revisionist as well as learned AGA for theState.

Notices to respondent no. 2 are dispensed with in view of the proposed order.

The present revision has been filed against the judgment and order dated 09.02.2024 passed by the Additional Principal Judge-1st, Family Court, Bahraich in Misc. Case No. 362/11/2020, "Smt. Rakha Devi Vs. Shravan Kumar, whereby the application filed by respondent no. 2 under Section 125 Cr.P.C. has allowed directing the revisionist to pay Rs. 3500/- per month to respondent no. 2 from the date of filing of the application.

Perused the record.

Perusal of the record shows that it is not in dispute that the revisionist and respondent no. 2 are husband and wife. It is also not in dispute that respondent no. 2 was subjected to cruelty due to demand of dowry and due to that she is residing away from the revisionist. She is destitute and unable to maintain herself, whereas, the revisionist is a healthy person and considering this fact, learned Court has awarded maintenance Rs. 3500/- to respondent no. 2.

From perusal of the impugned order dated 09.02.2024, I find no illegality or impropriety in the order impugned.

The revision is devoid of merits and is accordingly rejected.
