2. Having heard learned counsel for the parties and having perused the records, ends of justice would be suffice if the petitioner is permitted to file an appeal against the punishment order dated 24.12.2019 which was received by him in February, 2020 and thereafter, he filed claim petition on 28.07.2020 which has been dismissed on 24.05.2023, within one month. On an appeal being filed, the same shall be decided on merits, meaning thereby, it shall not be dismissed on the ground of limitation. A reasoned and speaking order shall be passed within three months. If the decision goes against the petitioner then he shall prefer a revision within the limitation prescribed from passing of the order of appeal. Based on the results therein, further remedies, if required, would be available to the petitioner.
3. With these observations, the judgment of learned Tribunal is modified in the aforesaid terms. The Claim Petition is disposed of accordingly so is the Writ Petition.
