1. Heard learned counsel for the parties.
2. Instant writ petition has been filed assailing the judgment/award dated 25.10.2023 passed by learned Commissioner under the under the Employee's Compensation Act, 1923 (in brevity "the Act, 1923").
3. Learned Standing Counsel has raised preliminary objection qua maintainability of the instant writ petition on the ground of availability of alternative remedy to file an appeal under Section 30 of the Act, 1923.
4. Learned counsel for the petitioner has not refuted the contention as raised by learned Standing Counsel qua availability of alternative remedy.
5. In this conspectus, as above, instant writ petition is dismissed, being not maintainable, on the ground of availability of alternative remedy, as mentioned above.
6. Office is directed to return the certified copy of the impugned judgment to the learned counsel for the petitioner after retaining its photo-stat copy at relevant place.
